DoorDash equipment driver in New York are about to get an extra gratuity — and one that they ’ve been owe for over half a decade . As part of asettlement announced by the state of New York ’s Attorney General , Letitia James , DoorDash has agreed to pay $ 16.75 million to more than 60,000 Dashers who were supposed to meet that money in the form of tips but rather , the company used it to cover base pay and pocketed the rest .
New York ’s lawsuit alleged that between May 2017 and September 2019 , tens of grand of Dashers were misled by DoorDash ’s salary role model . At the time , the ship’s company bid a guaranteed remuneration to drivers — the lower limit amount that they could carry to make from a job . But or else of paying that guarantee and letting drivers keep their tips , DoorDash counted the tip toward their al-Qaeda earnings and kept what was leave behind .
permit ’s say a driver is insure $ 10 on a delivery . DoorDash would pay a minimum of $ 1 of that no matter what , but the rest would descale based on how the person who place the social club tiptoe . If they left a $ 5 tip , DoorDash counted that toward the guaranteed $ 10 remuneration and covered the remain $ 4 on top of its $ 1 lower limit . If the tip was $ 7 , DoorDash just scaled down its own payment to $ 2 . Under this model , the only way the number one wood ever go through more than $ 10 was if the customer tipped mellow than the undertake payment — signify if they tip $ 11 , that one extra dollar sign over the $ 10 guarantee would really go to the driver instead of subsidizing DoorDash ’s side of the payout .

That payment model would be skeevy even if DoorDash accurately excuse how payments were distributed . But … it did n’t . Per the AG ’s lawsuit , DoorDash showed a content to customers that say “ Dashers will always encounter 100 percentage of the tip”—a affirmation that is technically lawful but does not clarify that “ confidential information ” is actually the livery drivers ’ remuneration . New York argued that disclosures explain how tips worked were buried in on-line document and “ customers had no agency of know that DoorDash was using peak to reduce its own costs . ”
DoorDash did eventuallychange its defrayment modelto ensure “ earnings will increase by the exact amount a client tips on every purchase order , ” but New York ’s case represents drivers finally getting those wind they garner during the period when the company was less transparent about who was in reality pocketing that excess cash .
Dashers eligible for the resolution will be reach by the closure administrator so they can get their part of the pie that was rightfully theirs in the first place . Better late than never .
