A 13-year-old Florida boy will be tried as an adult on a first-degree murder charge after the fatal stabbing of his mother, according to courtreports.
On Oct. 12, the teen allegedlycalledHialeah, Fla., police to tell them he had killed Garcia,Local 10,NBC MiamiandWSVNreported at the time, citing police.
He was arrested on the day of Garcia’s death, and booked into the Metro West Detention Center on Thursday, according to jail records.
At his bond hearing on Friday, the teen’s father and grandmother pleaded for him to be released on house arrest, according toNBC.
Rosa, who was unnamed in PEOPLE’s previous reports, was identified as a middle school honor student who was apologetic when officers arrived.
The teen is set to be arraigned on Tuesday. He will plead not guilty, his lawyer, Kristen Reynoso, says.
“He is a great kid all around,” Reynoso tells PEOPLE. “I’ve seen him interact with the staff at the Miami Dade Regional Juvenile detention center, and they hug him. The staff has also said how much they love him."
“I only know him to be sweet and respectful,” she adds.
While addressing a possible motive, Hialeah police spokesperson Eddie Rodriguez told NBC at the time, “We don’t know, that’s something that we’re still trying to figure out.”
Rodriguez alleged that the teen “did not say why he did this, all he did was call 911 and advise what he did.”

The teen also allegedly said that he “took pictures and told my friends about it, was that bad?” according to the report.
When the dispatcher asked about the teen’s infant sister, Rosa said she was asleep.
